Definitions
- App: MotoRider TR mobile application, website and all related services
- Operator: MotoRider TR (Avşar Ocak)
- User / You: The natural person using the App
- Content: All user-generated content including ride logs, messages, events, photos
Service Description
MotoRider TR is a community app for motorcycle riders providing:
- Ride tracking and statistics
- Social navigation and route planning
- Messaging and friendships with other riders
- Event organization (convoys, meet-ups, races, etc.)
- Help request system (roadside assistance)
- Information about nearby towing services, repair shops, tire shops
Account Registration and Age Limit
- You must be at least 18 years old to use the App.
- You must provide accurate information when registering.
- You are responsible for the confidentiality of your password. All actions taken with your account are yours.
- Only one account per person. Fake/multiple accounts will be closed.
- If you choose to sign in with Google or Apple, your use of these third-party services is also subject to that provider's (Google LLC / Apple Inc.) own terms and privacy policies.
- Parental consent is required for minors.
Riding Responsibility
Looking at your phone while riding a motorcycle is dangerous and illegal. When using MotoRider TR:
- Start ride tracking and place the phone in a safe location
- Do not interact with the phone while riding
- Do not check notifications or messages
- In emergencies, stop in a safe place first, then use the app
- Always prioritize road conditions, traffic, and riding safety
The user is responsible for accidents, injuries, or legal violations resulting from app use.
User Obligations
By using the App, you agree to:
- Follow all local traffic laws
- Use a valid driver's license and registered motorcycle
- Wear a helmet and necessary protective gear
- Not exceed legal speed limits
- Not engage in actions that endanger traffic or others
- Use the App in accordance with laws, morals, and these Terms
- Keep your account password and login details confidential; you are responsible for all activity on your account
- Ensure the accuracy of the information you enter (profile, motorcycle, location, listings, etc.)
- Ensure the content you share (photos, messages, listings, comments) complies with laws and third-party rights
- Maintain the security of your device and internet connection
Prohibited Behavior
The following behaviors are prohibited and will result in account closure:
- Impersonating others (imitation, fake accounts)
- Harassment, threats, insults, discrimination
- Spam, fraud, unauthorized advertising
- Sharing illegal, obscene, violent content
- Copyright infringement
- Attempting to bypass security systems
- Mass data collection (scraping, bots)
- Fake help requests or abusing the help system
- Location-based threats/harassment of other users
- Content encouraging dangerous riding (extreme speeding, drifting, wheelies)
User Content
- You own all content (photos, messages, comments) you share.
- By sharing, you grant us permission to display, distribute and backup the content (within the App only).
- Your content must not violate others' rights.
- We reserve the right to remove prohibited or harmful content.
All responsibility rests with the user. Any and all legal, criminal, and financial liability arising from any content you share in the app (photos, messages, comments, location, ride records, events, etc.) rests solely and entirely with the user who shared it. MotoRider TR cannot be held responsible for content shared by users. Ensuring the accuracy and lawfulness of your content, and that it does not infringe the rights of third parties, is entirely your responsibility.
Help Request System
In life-threatening situations, always call:
- 112 — Emergency services (ambulance, police, fire)
- 155 — Police
MotoRider help requests only notify nearby riders and towing services for minor breakdowns (flat tire, out of fuel, etc.). There is no guarantee of response. For emergencies, call 112 for professional help.
Towing and Repair Service Relationships
- The App lists towing/repair service providers as an intermediary.
- Service quality, pricing, and contract terms are the service provider's responsibility.
- MotoRider TR is not a party between the user and service provider.
- In case of disputes, contact the service provider directly.
Intellectual Property
- MotoRider TR brand, logo, design, and code belong to Avşar Ocak.
- Unauthorized copying, reproduction, distribution is prohibited.
- Third-party brands and logos (motorcycle brands, etc.) belong to their owners.
Fees and Premium Services
- Core features of the App are free.
- Premium services (advanced statistics, hardware products, etc.) may be added in the future.
- All payments are processed through Apple App Store / Google Play.
- Subscription cancellation must be done through the respective platform.
Account Termination
We reserve the right to close your account in the following situations:
- Violation of these Terms
- Illegal use
- Harming other users
- Fake/multiple accounts
- No activity for more than 6 months (with backup)
You can also close your account at any time via Profile → Settings → Delete Account.
Disclaimer of Liability
MotoRider TR cannot be held responsible for:
- Accidents, injuries, or damages experienced by users while using the App
- Wrong routes due to incorrect GPS data
- Disputes arising from private agreements between users
- Errors by third-party service providers (towing, repair shops)
- Disruptions caused by device, internet, or infrastructure
- Hardware/software incompatibility
- Content published by other users
Data security: MotoRider TR takes reasonable technical and organizational measures to protect your personal data under KVKK Art. 12 (including encrypted connections, access controls, database row-level security, and secure infrastructure). However, no system can guarantee that transmission over the internet or electronic storage is 100% secure; in the event of unforeseeable and unpreventable breaches, MotoRider TR is liable only to the extent required by applicable law.
User responsibility: The confidentiality of your password, the security of your device, the accuracy of the information you enter, and the content you share are your responsibility. MotoRider TR cannot be held liable for damages resulting from sharing your password, using a weak password, or your device falling into others' hands.
Limitation of liability: To the maximum extent permitted by applicable law, MotoRider TR is not liable for indirect, incidental, or consequential damages (data loss, loss of profit, loss of business or use, etc.). Your mandatory consumer-law rights remain reserved.
The App is provided "as is"; no guarantee of uninterrupted operation. However, reasonable effort is made to ensure service continuity.
Changes
We may update these Terms from time to time. We will notify you in the app for significant changes. Continuing to use the app after changes means you accept the new Terms.
Governing Law and Jurisdiction
- These Terms are governed by the laws of the Republic of Türkiye.
- Istanbul Courts and Enforcement Offices have jurisdiction over disputes.
- For consumer disputes, relevant Consumer Arbitration Committees have jurisdiction.
